El caso Brewer-Carías vs. Venezuela: Lecciones desde la perspectiva del debido proceso

Abstract

El presente artículo analiza el dictamen del Comité de Derechos Humanos de la ONU, de 18 de octubre de 2021, que ha venido a reparar los efectos producidos por la sentencia de la Corte Interamericana de Derechos Humanos en el caso del jurista venezolano Allan Brewer-Carías, particularmente en lo que se refiere a la vulneración del derecho de acceso a la justicia en conexión con el derecho a un recurso efectivo para tutelar los derechos protegidos a nivel internacional.

This article analyzes the judgment of the ONU Human Rights Committee, dated October 18, 2021, which has come to repair the effects produced by the decission of the Inter-American Court of Human Rights in the case of the Venezuelan jurist Allan Brewer- Carías, particularly with regard to the infringement of the right of access to justice in connection with the right to an effective remedy to assure the rights protected by international level.
