Algunas lecciones derivadas del proceso constituyente o populismo constitucional desarrollado en Venezuela en 1999, que podrían ser útiles para el proceso constituyente chileno de 2021

Abstract

Este artículo estudia el contraste entre el proceso constituyente que se desarrolló en Venezuela en 1999, sin que hubiera habido acuerdo político alguno entre los partidos y sin estar regulado en la Constitución de 1961, y cuyo desarrollo implicó que la Asamblea Nacional Constituyente usurpara la voluntad popular y el poder constituyente originario, interviniera los poderes públicos constituidos y violara la Constitución vigente; con el proceso constituyente que se desarrolló en Chile en 2021, con base en un gran acuerdo político entre todos los partidos, que condujo a una reforma de la Constitución para regular la Convención Constitucional, a la cual se le fijó el estatuto de su funcionamiento, sin posibilidad de intervenir a los poderes constituidos y en todo caso sometiéndose a la Constitución vigente.

This article studies the contrast between the constituent process that took place in Venezuela in 1999, without any political agreement between the parties and without being regulated in the 1961 Constitution, and whose development implied that the National Constituent Assembly usurped the popular will and the original constituent power, intervened the constituted public powers and violated the current Constitution; with the constituent process that took place in Chile in 2021, based on a great political agreement between all the parties, which led to a reform of the Constitution to regulate the Constitutional Convention, to which the statute of its operation was fixed, without the possibility of intervening to the constituted powers and in any case submitting to the current Constitution.
