La libertad de expresión en las redes sociales y su restricción por parte del Estado

Abstract

El artículo, con base en el derecho convencional e interno, busca responder a la interrogante de cuáles son los límites a los que se encuentra sujeto el ejercicio del derecho a la libertad de expresión en las redes sociales en Venezuela y que, en consecuencia, permitirían al Estado determinar responsabilidades e imponer sanciones por su violación, sin dejar de lado las obligaciones que ese Estado también tiene para la salvaguarda de la libertad comentada y los principios que deben considerarse al momento de restringir uno de los derechos fundamentales de un Estado democrático.

The paper, based on conventional and internal law, seeks to answer the question of what are the limits to which the exercise of the right to freedom of expression in social networks is subjected in Venezuela and that, consequently, would allow the State to determine responsibilities and impose sanctions for their violation, without neglecting the obligations that that State also has to safeguard that freedom and the principles that must be considered when restricting one of the fundamental rights of a democratic State.
