Del derecho a la propiedad y libertad en Venezuela. Del exceso de estado al estado totalitario

Abstract

En Venezuela, constitucionalmente, se han reconocido los derechos individuales, en especial, el de propiedad y libertad; sin embargo, en los últimos años, gracias al abuso de intervención del Estado sobre la actividad de los particulares, ha mermado de tal forma, que los mismos quedan solo como instituciones meramente formales, carentes de contenido, llevándonos a un abrumador y desgastante totalitarismo. Sin embargo, la respuesta ante tales atropellos lo encontramos en los principios y fundamentos del Derecho Administrativo, que, ante un cambio de la forma de gobierno, es necesario rescatar.

In Venezuela, constitutionally, individual rights have been recognized, especially that of property and freedom; however, in recent years, thanks to the abuse of State intervention in the activity of individuals, it has decreased in such a way that they remain only as merely formal institutions, devoid of content, leading to an overwhelming and exhausting totalitarianism. However, the response to such abuses is found in the principles and foundations of Administrative Law, which, in the face of a change in the form of government, it is necessary to rescue.
