El acto conclusivo de sobreseimiento.

Abstract

En el presente trabajo se realizará un análisis de la figura del sobreseimiento en el proceso penal venezolano orientado a su naturaleza como acto conclusivo de la fase preparatoria. A estos fines se expondrán, mediante una investigación documental, aspectos relativos a los supuestos de procedencia de dicha actuación, la necesidad de contar con un imputado como sujeto al que se refiere, la posibilidad de aplicar simultáneamente las diversas causales de sobreseimiento establecidas en el Derecho vigente, los efectos de la declaratoria con lugar de la solicitud de sobreseimiento, su trámite, los recursos disponibles ante la decisión que declara procedente la solicitud y el procedimiento en caso de su declaratoria sin lugar.

The investigation analyzed the figure of dismissal in the Venezuelan criminal process, being its nature oriented as the conclusive act of the preparatory phase. With the aforementioned goal in mind, a documentary investigation will be made in order to exhibit the relative aspects needed in the assumptions of provenance of a dismissal, the necessity of having an accused as subject, the possibility of applying simultaneously the diverse grounds of the dismissal established in hard law, the effects of the due process with a formal finding of grounds in the dismissal, the process, the possible legal action against the decision that finds grounds in a dismissal and the process in case the dismissal is denied.
