Aborto terapéutico de oficio en menores de 14 años en Perú: un enfoque en la protección de la integridad personal

Abstract

Este estudio surge de la motivación debido a la publicación del caso Camila versus Perú, en el cual en el año 2017 se vulneró totalmente el derecho de una menor de 13 años, obligándola a proseguir con la gestación producto de un abuso continuado por parte de su progenitor. El objetivo de este estudio fue analizar cómo el aborto terapéutico de oficio a menores de 14 años contribuye a la protección de su integridad personal. Para ello, la investigación se desarrolló bajo el enfoque cualitativo, de tipo básica, con diseño documental, en la que se indagó en diversas fuentes documentales como artículos, leyes, regulaciones, informes y periódicos. La técnica empleada fue el análisis documental, y el instrumento la guía de análisis documental. Los resultados indican que, aunque existen normas que avalan el aborto terapéutico en Perú, se identificó la escasa aplicación de esta medida en menores de edad, lo cual repercute en la salud física, emocional y psicológica de la gestante, además de vulnerar su integridad personal. Se concluye que, el Estado peruano tiene la responsabilidad de tomar medidas activas para asegurar la salud y la integridad personal de las menores embarazadas, inclusive en contextos en los que el aborto terapéutico afronta obstáculos sociales o morales. This study arises from the motivation due to the publication of the case Camila versus Perú, in which in 2017 the right of a minor under 13 yearsof age was totally violated, forcing her to continue with the pregnancy as a result of continued abuse by her progenitor. The objective of this study was to analyze how ex officio therapeutic abortion for children under 14 years of age contributes to the protection of their personal integrity. To this end, the research was developed under a qualitative approach, of a basic type, with a documentary design, in which various documentary sources such as magazines, laws, regulations, reports and newspapers wereinvestigated. The technique used was documentary and content analysis, and the instrument was the documentary analysis guide. The results indicate that, although there are regulations that support therapeutic abortion in Peru, the limited application of this measure in minors was identified, which has an impact on the physical, emotional and psychological health of the pregnant woman, in addition to violating her personal integrity. It is concluded that the Peruvian State has the responsibility to take active measures to ensure the health and personal integrity of pregnant minors, even in contexts in which therapeutic abortion faces social or moral obstacles. The ex officio therapeutic abortion constitutes a manifestation of said state responsibility
