El proceso civil en el ordenamiento Jurídico Venezolano ha sido el objetivo fundamental para el desarrollo de esta investigación. En este sentido, se han observado dos criterios que definen las medidas de protección y garantías procesales; una, ha destacado que la misma se confina a lo establecido en el artículo 26 de la Constitución de la República Bolivariana de Venezuela; y otro criterio establecido en el artículos 49 descritos en las garantías constitucionales accesorias del debido proceso. Se reflexiona que, el derecho civil venezolano, es un extenso derecho establecido no solo en uno de los anteriores criterios, sino que ambos razonamientos al fusionarlos con el articulo 19 eiusdem, conforman una amplia concepción sobre la Tutela Judicial Efectiva al establecer el goce y ejercicio como garantía irrenunciable, indivisible e interdependiente de los derechos humanos, pues en esencia la Tutela Judicial realmente efectiva no es más que el cumplimiento y respeto cabal de los Derechos fundamentales en general, según sea el caso planteado.; The purpose of this paper is to analyze the Venezuelan civil process and fundamental rights in relation to protection measures and procedural guarantees. The civil process in the Venezuelan legal system has been the fundamental objective for the development of this investigation. In this sense, two criteria have been observed that define the protection measures and procedural guarantees; one, has emphasized that it is confined to what is established in article 26 of the Constitution of the Bolivarian Republic of Venezuela; and another criterion established in article 49 described in the constitutional guarantees of due process. It is reflected that Venezuelan civil law is an extensive right established not only in one of the above criteria, but both reasoning by merging them with Article 19 eiusdem, make up a broad conception of Effective Judicial Guardianship when establishing enjoyment and exercise as an inalienable, indivisible and interdependent guarantee of human rights, since, in essence, effective judicial protection is nothing more than compliance with and full respect for fundamental rights in general, as the case may be. Tue, 01 Jan 2019 00:00:00 GMT http://bdigital2.ula.ve:8080/xmlui/654321/14259 2019-01-01T00:00:00Z http://bdigital2.ula.ve:8080/xmlui/654321/14258 Fiscalización tributaria en la ley orgánica de telecomunicaciones Ángulo, Adriana; Melean Brito, Jorge La presente investigación pretende abordar suficientemente el Bloque 76 Normativo de la Potestad Administrativa Estatal de Fiscalización Tributaria de la Comisión Nacional de Telecomunicaciones (CONATEL), a través de una investigación documental, a los puros fines, de describir esclarecidamente, la dinámica de ese procedimiento administrativo en el Sector Económico Fuertemente Regulado de las Telecomunicaciones. Y, aunque las autoridades reguladoras quedan enmarcadas por la Ley del Sector Económico referido, la LOAP y la LOPA (en ese orden), la Ley del Sector, no regula latamente el procedimiento. Al contrario, ésta Ley remite palpablemente al Código Orgánico Tributario. Quedando CONATEL, el Ministerio de Ciencia y Tecnología y otras autoridades técnicas, como los competentes en la cobranza y administración de los Tributos Especiales tipificados en la LOTEL. No obstante, la LOTEL regula los aspectos sustantivos propios de la obligación tributaria de cada tributo. De tal manera, que instituye los condicionamientos previos, o adjetivos, de la Fiscalización Tributaria referida; pudiéndose concluir, que la regulación existe, pero, es indirecta, a través de las normas de la obligación tributaria.; The present investigation intends to sufficiently address the Normative Block of the State Administrative Power of Tax Inspection of the Venezuelan Telecommunications Commission (CONATEL), through a documentary investigation, for the pure purposes, to describe clearly, the dynamics of this administrative procedure in the Strongly Regulated Economic Quadrant of Telecommunications. And, although the regulatory authorities are framed by the aforementioned Law of the Economic Quadrant, the LOAP and the LOPA (in that order), the Quadrant Law does not regulate the procedure as much as possible. On the contrary, this Law refers palpably to the Organic Tax Code. Remaining CONATEL, the Ministry of Science and Technology and other technical authorities, such as those competent in the collection and administration of the Special Taxes typified in the LOTEL. However, the LOTEL regulates the substantive aspects of the tax obligation of each tax. In such a way, that it institutes the previous conditionings, or adjectives, of the aforementioned Tax Examination; being able to conclude that the tax regulation exists, but it is indirect, through the rules of the tax obligation.
