El control judicial y las nuevas tendencias procesales en la provincia de Corrientes, Argentina: principales innovaciones

Abstract

Por medio de la presente investigación, se pretende exponer las principales innovaciones procesales de la Provincia de Corrientes-Argentina. Para tal fin, se llevó a cabo una investigación documental que requirió de una revisión bibliográfica extensiva, aunada a la implementación de la dogmática lege ferenda para dilucidar su verdadero alcance sobre los ciudadanos, y en como trasciende sobre la efectividad de la tutela judicial efectiva de las pretensiones individual y colectivas. De igual manera, se pretende acordar las nuevas tendenciales procesales incorporadas en el sistema jurídico. Se entiende, que la Provincia de Corrientes ha hecho un esfuerzo que apunta en esa dirección, y es de esperar que todos los operadores jurídicos, así lo visualicen, y procuren su recta aplicación, puesto que constituye un deber del Estado adoptar las medidas tendientes a garantizar el efectivo respeto de los derechos fundamentales, conforme puntualiza la Constitución argentina al respecto.

Through the present investigation, it is intended to expose the main procedural innovations of the Province of Corrientes-Argentina. For this purpose, a documentary investigation was carried out that required an extensive bibliographical review, together with the implementation of the dogmatic lege ferenda to elucidate its true scope on citizens, and how it transcends the effectiveness of the effective judicial protection of individual and collective claims. In the same way, it is intended to agree on the new procedural trends incorporated into the legal system. It is understood that the Province of Corrientes has made an effort that points in that direction, and it is to be hoped that all legal operators will see it as such, and seek its correct application, since it is a duty of the State to adopt measures tending to guarantee the effective respect of fundamental rights, as specified in the Argentine Constitution in this regard.
