El municipio en la ley orgánica nacional y su incidencia en el ámbito rural

Abstract

La investigación tiene por objeto analizar la importancia del municipio rural y su incidencia en la Ley venezolana. Es una investigación documental, bibliográfica, histórica, comparativa y descriptiva. La Ley no prevé el municipio rural, aun cuando algunas de las Constituciones invocan la creación de diferentes regímenes municipales para ser desarrollados legalmente. Sin embargo, la Ley Orgánica de Régimen Municipal y Ley Orgánica del Poder Público Municipal, han omitido condiciones especiales importantes (desarrollo económico, situación geográfica, elementos históricos y culturales), que las Constituciones han exigido para crear diferentes regímenes municipales y cuando la Constitución actual las invoca, son excluidas por el legislador. La finalidad concreta es despertar el interés en el legislador venezolano para lograr la inclusión del municipio rural en la Ley Orgánica del Poder Público Municipal y así, garantizar que las Políticas Públicas Rurales, sean descentralizadas en el ámbito local.

The research aims to analyze the importance of the rural municipality and its impact on the Venezuelan Law. It is a documentary, bibliographical, historical, comparative and descriptive research. The Law does not provide for the rural municipality, even though some of the Constitutions call for the creation of different municipal regimes to be legally developed. However, the Organic Law of Municipal Regime and the Organic Law of Municipal Public Power have omitted important special conditions (economic development, geographical location, historical and cultural elements), which the Constitutions have required to create different municipal regimes and when the current Constitution invokes them, they are excluded by the legislator. The specific purpose is to arouse interest in the Venezuelan legislator to achieve the inclusion of the rural municipality in the Organic Law of Municipal Public Power and thus ensure that Rural Public Policies are decentralized at the local level.
