Admisión de los hechos, rebaja de pena y castigo en el homicidio

Abstract

Con este trabajo se pretende abordar la problemática que plantea la aplicación del procedimiento especial por admisión de los hechos con relación al juzgamiento del delito de homicidio intencional, la cual trasciende la dicotomía existente entre la prevención eficaz de este delito y la rebaja de pena aplicable al imputado que admite los hechos. De este modo, el rechazo que recibe la rebaja de pena que se concretaría por virtud de la admisión, con respecto a la sanción que merece un delito tan grave como el homicidio intencional, coloca en un segundo plano un aspecto que caracteriza al procedimiento especial, a saber, el de la renuncia a las garantías del juicio oral.

This paper aims to address the problem posed by the application of the special procedure for admission of the facts in relation to the prosecution of the crime of intentional homicide, which transcends the existing dichotomy between the effective prevention of this crime and the reduction of the penalty applicable to the accused who admits the facts. In this way, the rejection that the reduction of sentence that would be specified by virtue of the admission receives, with respect to the sanction that a crime as serious as intentional homicide deserves, places in the background an aspect that characterizes the special procedure, namely, the waiver of the guarantees of the oral trial
