Responsabilidad ambiental del estado en materia de aguas Venezuela

Abstract

La relación individuo, sociedad y naturaleza, ha variado a lo largo de los siglos. Al principio de la historia humana, la naturaleza era considerada por la mayoría de las poblaciones como algo sagrado, debido a que había sido creada por Dios. Luego, con posterioridad a la II Guerra Mundial, se aceleró el crecimiento económico principalmente en los países desarrollados, sin preocuparse por las consecuencias sobre los recursos naturales y el ambiente, afectando aceleradamente el deterioro de estos. Por tal razón la temática aquí contada se reviste de importancia, motivado a lo novedoso de esta materia en el ordenamiento jurídico venezolano a vivir en un ambiente sano, seguro y ecológicamente equilibrado. Se aspira como aporte prevenir a la sociedad y a los organismos oficiales sobre la importancia de la Responsabilidad Ambiental en materia de aguas en Venezuela y la aplicación efectiva de las leyes ambientales en función de promover nuevas formas de gestión con visiones modernas dentro de la administración pública para la tutela efectiva de los recursos naturales renovables. En el presente trabajo se describe la situación del estado en asumir la obligación de garantizar a la población venezolana una mejor calidad de vida, para lo cual se deberán modificar las leyes existentes y sancionar otras normas que le permitan llevar a cabo una gestión ambiental exitosa en el cual la protección y preservación ambiental, sean primordiales dentro de las políticas ambientales venezolanas. La investigación se enmarca dentro del tipo de investigación cualitativa tiene un carácter documental apoyado en un estudio descriptivo, analítico y jurídico.

The individual, society and nature relationship has varied over the centuries. At the beginning of human history, nature was considered by most populations as something sacred, because it had been created by God. Then, after World War II, economic growth accelerated mainly in developed countries, without worrying about the consequences on natural resources and the environment, rapidly affecting their deterioration. For this reason the theme told here is important, motivated to the novelty of this matter in the Venezuelan legal system to live in a healthy, safe and ecologically balanced environment. It is intended as a contribution to prevent society and official bodies on the importance of Environmental Responsibility in matters of water in Venezuela and the effective application of environmental laws in order to promote new forms of management with modern visions within the public administration to the effective protection of renewable natural resources. This paper describes the situation of the state in assuming the obligation to guarantee the Venezuelan population a better quality of life, for which the existing laws must be modified and other regulations that allow it to carry out a successful environmental management in which the protection and environmental preservation, are fundamental within the Venezuelan environmental policies. The research is part of the type of qualitative research has a documentary character supported by a descriptive, analytical and legal study.
