Traspasando las Barreras: Haz de los Hechos tus Derechos. the Adopción, una Realidad sin Miedo

Abstract

La presente investigación pretende explicar un tema del Derecho Civil Familiar como la Adopción con finalidad de describir su marco constitucional y legal respectivo. Fue utilizada una metodología puramente descriptiva, que permita al Lector entender fácilmente la esencia de la Adopción como institución social de integración del individuo en un Grupo Familiar cónsono con su situación. El Texto Constitucional de 1999 crea un marco referencial de protección de los intereses superiores del niño y del adolescente por encima del derecho subjetivo del Adoptante. La Adopción ya no es sólo una institución, o de un derecho subjetivo privado activo del Adoptante, sino un derecho subjetivo pasivo del Adoptado. De donde es necesario, conciliar a ambos derechos legítimos, con una mayor prioridad con el segundo, a través del velo protector del Estado con instituciones administrativas especializadas.

The next investigation pretends explain a special topic of Family Civil Law like the Adoption, towards to describe the Constitution and the respective Law. It was applied a descriptive method, which allows to the students understand easily the substance of the adoption as a social institution of integration of the person in a Family Group, according his situation. The Constitutional Law of 1999 creates an allusion juridic act of protection of the higher’s interests of the Childs and Teenagers, over the right of the Adoptants. The Adoption is not longer an institution, or a simple private and active right of the Adoptant, if not a passive right of the Adopted. In this situation, the State will conciliate both rights, with a priority of the right of the Adopted in front the Adoptant, through the protection of the State with administrative institutions.
