Comparación de los estatutos de protección temporal para venezolanos promulgados por Colombia y Estados Unidos

Abstract

Los mecanismos de protección temporal de Colombia y Estados Unidos buscan la integración de los migrantes de supervivencia. Para atender el caso venezolano, Colombia ha creado un marco legal ad hoc; mientras que Estados Unidos ha recurrido a un mecanismo anteriormente promulgado. En este artículo comparamos la idea central de ambos documentos, la justificación de la acción de protección, el carácter de los permisos otorgados y las autoridades encargadas de la promulgación de los instrumentos. El tema es tratado como parte de un programa más amplio que permita diseñar líneas de acción para lograr instrumentos semejantes de otros gobiernos.

The goal of the mechanisms of temporal protection of Colombia and The United States is the integration of the survival migrants. To ameliorate the current situation of the Venezuelan migrants, Colombia has created an ad hoc legal frame, while the United States has used an already enacted law. In this paper, we compare the main idea of both documents, the justification of the protection, the features of the eligibility and employment authorization, and the enacting authorities. The treatment of this subject follows a broader program, which could allow us to design similar instruments for other governments.
