Los derechos humanos y sus adversarios

Abstract

Este trabajo sintetiza una serie de estudios sobre las críticas a la idea de los derechos humanos que el autor viene realizando desde hace años. Se revisan aquí con especial atención las críticas clásicas de E. Burke, J. Bentham y K. Marx, pero también las objeciones actuales que en cierto modo suponen una actualización de las anteriores: las críticas procedentes del relativismo cultural, del positivismo jurídico y del antiimperialismo. El estudio y la valoración de este poderoso arsenal de críticas permiten llegar a la conclusión de que la doctrina de los derechos humanos, aunque en algunos aspectos requiere ciertas correcciones, sigue siendo válida en lo esencial y debe seguir iluminando la compleja trayectoria de la humanidad.

The present paper summarises several studies regarding criticism towards the idea of human rights that the author has been conducting over the last years. Special attention is paid to the classic critics by E. Burke, J. Bentham, and K. Marx, but also to the current objections that represent an update of the former in a certain way: those critics coming from cultural relativism, legal positivism and anti-imperialism. The study and assessment of such a powerful arsenal of critics allows to reach the conclusion that the human rights doctrine is still essentially valid, even if it needs certain corrections, and that it must continue shedding light on the complex evolution of humankind.
