Estados de Excepción en Venezuela

Abstract

El término «Estado de Excepción» es acuñado por primera vez en la Constitución del año 1999. No obstante, es posible encontrar normas que versan sobre el derecho de excepción en toda la historia constitucional de Venezuela desde el año 1811, permitiendo sostener que el derecho de excepción en Venezuela evolucionó, al pasar de ser únicamente para supuestos de conflictos armados, a otras circunstancias como epidemias, calamidades o condiciones socioeconómicas de gravedad. En este contexto, se abordará, analizando ¿quién puede decretar un estado de excepción?, y estableciendo ¿Cuáles son los motivos del estado de excepción?, documentando aproximadamente, el contenido de los decretos de excepción, el control político y jurídico, en Venezuela. Estas medidas consistieron en la restricción de las garantías constitucionales: la inviolabilidad del hogar y las comunicaciones privadas, el libre tránsito, la reunión, la manifestación y, obvio, la libertad económica; los estados de excepción sería el mecanismo del gobierno implementado para contener la inestabilidad.

The term “State of Exception” is coined for the first time in the Constitution of 1999. However, it is possible to find norms that deal with the right of exception throughout the constitutional history of Venezuela since 1811, allowing us to maintain that the right of exception in Venezuela evolved, from being only for cases of armed conflicts, to other circumstances such as epidemics, calamities or serious socioeconomic conditions. In this context, it will be addressed, analyzing who can decree a state of exception? and establishing what are the reasons for the state of exception?, documenting approximately the content of the decrees of exception, political and legal control, in Venezuela. These measures consisted of the restriction of constitutional guarantees: the inviolability of the home and private communications, free movement, assembly, demonstration and, obviously, economic freedom; States of exception would be the government mechanism implemented to contain instability.
