La doctrina interpretativa del acto aclarado del Tribunal de Justicia de la Comunidad Andina

Abstract

En el presente trabajo académico los autores describen los factores que llevaron al Tribunal de Justicia de la Comunidad Andina a adoptar el criterio jurídico interpretativo del acto aclarado, así como las fuentes que lo inspiraron en dicha empresa. Se ofrece un análisis exhaustivo de la naturaleza de esta figura y su aplicación en la Comunidad Andina, así como una evaluación de las medidas empleadas para su divulgación y los resultados de esta innovación jurisprudencial.

In this academic work, the authors describe the factors that led the Court of Justice of the Andean Community to adopt the legal interpretive criterion of the clarified act, as well as the sources that inspired it in this endeavor. An exhaustive analysis of the nature of this figure and its application in the Andean Community is offered, as well as an evaluation of the measures used for its dissemination and the results of this jurisprudential innovation.
