Breves consideraciones sobre la prueba de juramento, con especial referencia al juramento estimatorio

Abstract

La ley estipula que, en los juicios sobre obligaciones civiles procedentes del hecho ilícito, culpa o dolo, que se encuentren debidamente comprobados, y ante la imposibilidad de probar el número o valor de las cosas demandadas o el importe de los daños y perjuicios, el juez puede deferir el juramento al demandante, para la comprobación de estos. Sin embargo, es inexistente el uso de esta prueba en nuestro medio. Por ello, consideramos necesario realizar un estudio sobre el juramento estimatorio, a fin de indagar sobre su utilidad.

The law stipulates that in trials on civil obligations arising from an illicit act, fault or fraud, which are duly proven, and in the event of the impossibility of proving the number or value of the things demanded or the amount of damages, the judge may defer the oath to the plaintiff, for verification of these. However, the use of this test does not exist in our environment. For this reason, we consider it necessary to carry out a study on the estimatory oath, in order to investigate its usefulness.
