El estrecho de Ormuz: Su situación jurídica

Abstract

Desde hace ya algunos años, la República Islámica de Irán viene amenazando con un eventual cierre del Estrecho de Ormuz, del que es Estado ribereño. La preocupación por los efectos negativos que pudiera conllevar dicho cierre, sobre todo desde el punto de vista económico, habida cuenta que es el estrecho con mayor volumen de tráfico de petroleros del mundo, nos lleva a analizar si dicho cierre sería legítimo. Nos preguntamos si desde el punto de vista del Derecho internacional Irán tiene derecho a cerrar el Estrecho de Ormuz. Un análisis que se centra principalmente en las normas del Derecho del Mar relativas a los estrechos internacionales.

In recent years, the Islamic Republic of Iran is threatening a possible closure of the Strait of Hormuz, which is a coastal State. Concern about the negative effects that could lead the closure, especially from the economic point of view, given that is the strait with greater traffic of oil in the world, leads us to analyze whether the closure would be legitimate. We wonder if from the point of view of International Law Iran has the right to close the Strait of Hormuz. An analysis that focuses mainly on the rules of the Law of Sea concerning the international strait.
