Análisis del crimen de asesinato en Venezuela. Patrones, recurrencia y selectividad a la luz de la Situación I ante la Corte Penal Internacional

Abstract

En este ensayo se examina el crimen de asesinato en Venezuela, sus posibles patrones, recurrencia y selectividad a la luz de la Situación I ante la Corte Penal Internacional. Conforme a lo indagado, se puede concluir que, jurídicamente, hay bases razonables para afirmar que esos hechos punibles se han perpetrado en territorio venezolano, tal como ya ha sido determinado por organismos internacionales. Este estudio se enfoca en la conexión con el crimen de persecución. Se hace una exégesis de los tipos penales y, finalmente, se realizan recomendaciones.

This essay examines the crime of murder in Venezuela, its possible patterns, recurrence, and selectivity in light of Situation I before the International Criminal Court. According to the investigation, it can be concluded that, legally, there are reasonable grounds to affirm that these punishable acts have been perpetrated in Venezuelan territory, as has already been determined by international organizations. This study focuses on the connection to the crime of persecution. An exegesis of the criminal types is made, and, finally, recommendations are made.
