La justicia digital en los albores del siglo XXI

Abstract

Las innovaciones tecnológicas representan alternativas para abordar escenarios de emergencia que se puedan generar en la vida humana. De esto no escapa la aplicación del derecho y la práctica en el sistema judicial. Por eso, el propósito general de este trabajo fue analizar la importancia de la justicia digital en los albores del siglo XXI. Para ello, se implementó un estudio de carácter documental bajo un enfoque cualitativo para el desglose del fenómeno investigado. Así pues, se determinó que el concepto de justicia digital fue catalizado con la crisis por COVID 19 y representa una figura que entraña retos y oportunidades, las cuales principalmente se adhieren a su interrelación con la brecha digital y la búsqueda de una justicia que no necesariamente requiera de asistencia presencial en cuanto a su configuración. Se concluyó que la e-justice tiene su asidero en el aseguramiento de los derechos de las personas y se recomendó mantener su monitoreo para observar su efectividad dentro de las estructuras de los Estados

Technological innovations represent alternatives to address emergency scenarios that may arise in human life. The application of law and practice in the judicial system does not escape this. Therefore, the general purpose of this work was to analyze the importance of digital justice at the dawn of the 21st century. To this end, a documentary study was implemented under a qualitative approach to break down the phenomenon investigated. Thus, it was determined that the concept of digital justice was catalyzed by the COVID 19 crisis and represents a figure that entails challenges and opportunities, which mainly adhere to its interrelationship with the digital divide and the search for a justice that does not necessarily requires in-person assistance regarding its configuration. It was concluded that e-justice has its basis in ensuring the rights of people and it was recommended to maintain its monitoring to observe its effectiveness within the structures of the States
