La vacancia presidencial por incapacidad moral permanente y el Sistema constitucional peruano

Abstract

La actual investigación tiene como finalidad analizar las percepciones sobre la vacancia por incapacidad moral permanente y la contravención al sistema constitucional, ante la ausencia normativa sobre el contenido y alcances de esta institución en el ordenamiento jurídico peruano. De esta forma, ha sido indispensable establecer qué ideas tienen los abogados que ejercen libremente en la Lima Metropolitana sobre la institución de vacancia por incapacidad moral permanente y la contravención de esta institución al sistema constitucional peruano. En la misma ruta se elabora un examen agudo de cada noción relacionada a la vacancia presidencial por incapacidad moral permanente como también al sistema constitucional peruano. Para ello, se acude a variados insumos académicos desde una óptica doctrinaria, utilizando además resoluciones judiciales y opiniones de expertos en este ámbito, a fin de determinar el contenido y alcances de la institución jurídica de la incapacidad moral permanente del presidente como causal de vacancia presidencial. Toda la información aportada en la investigación ha permitido determinar que la apreciación de los abogados que cumplen labor en la capital respecto de la vacancia por incapacidad moral permanente es favorable, pero concuerdan que subsiste una contravención al sistema constitucional al no tener un contenido y alcance delimitado.

The purpose of this research is to analyze the perceptions about the vacancy due to permanent moral incapacity and the violation of the constitutional system, in the absence of regulations on the content and scope of this institution in the Peruvian legal system. In this way, it has been essential to determine the perception of lawyers who work in Metropolitan Lima on the institution of vacancy due to permanent moral disability and the contravention of this institution to the Peruvian constitutional system. In this sense, a deep analysis of each concept related to the presidential vacancy due to permanent moral incapacity as well as the Peruvian constitutional system is carried out. For this, different academic materials are used from a doctrinal point of view, as well as judicial resolutions and interviews with experts on the subject, in order to determine the content and scope of the legal institution of the permanent moral incapacity of the president as causal presidential vacancy. All the information provided in the investigation has made it possible to determine that the perception of the lawyers who work in Metropolitan Lima on the vacancy due to permanent moral disability is favorable, but they consider that there is a contravention of the constitutional system by not having a delimited content and scope.
