El Derecho al Matrimonio Igualitario: Una mirada a la opinión consultiva 24/17 a través del control de convencionalidad

Abstract

El derecho de igualdad ante la ley y el principio de no discriminación son elementos imprescindibles para analizar el alcance del derecho al matrimonio entre parejas del mismo sexo. Ello, vinculado al deber de aplicar el control de convencionalidad a cargo de los Estados Parte de la Convención Americana sobre Derechos Humanos ha resultado un punto de desencuentro en algunos países de la región, que, se han negado a reconocer el alcance del derecho a la protección familiar que ha establecido la Corte Interamericana de Derechos Humanos a través de su función consultiva e interpretativa, aun cuando ello pueda comprometer tanto la responsabilidad internacional del Estado en cuestión, como el reconocimiento de la dignidad y de derechos humanos en condición de igualdad de un grupo históricamente discriminado.

The right to equality before the law and the principle of nondiscrimination are essential elements for analyzing the scope of the right to marriage between same-sex couples. This, related to the duty of States Parties to the American Convention on Human Rights to apply conventionality control, has been a point of disagreement in some countries of the region, which have refused to recognize the scope of the right to family protection established by the InterAmerican Court of Human Rights through its advisory and interpretative function, even when this could compromise both the international responsibility of the State in question and the recognition of the dignity and equal human rights of a group that has historically been discriminated against.
