El Petro Venezolano: Reflexiones sobre una falacia monetaria y pretendida unidad de cuenta

Abstract

El Petro no es moneda ni unidad de cuenta monetaria. Tampoco es un criptoactivo. Se trata de una forma simulada para (i) dolarizar y (ii) descontinuar el uso del bolívar (y la UT) como unidad de cuenta de las obligaciones tributarias principales y accesorias. El uso del Petro infringe los artículos 318 Constitucional, 3 y 146 del COT 2020 y 116 de la LBCV que ordenan el uso del bolívar como unidad de cuenta y pago de las obligaciones tributarias como un requisito de estricta reserva legal.

The Petro is neither a currency nor a monetary unit of account. Is not a cryptoasset either. It is a simulated way to (i) dollarize and (ii) discontinue the use of the bolivar (and the UT) as the unit of account for main and accessory tax obligations. The use of the Petro violates articles 318 of the Constitution, 3 and 146 of the COT 2020 and 116 of the LBCV that mandate the use of the bolivar as a unit of account and payment of tax obligations as a requirement of strict legal reserve.
