¿Quién controla al contralor? Golpe parlamentario a la Constitución de Venezuela y desmantelamiento de la transición hacia la democracia

Abstract

La reforma del Estatuto que rigiese la Transición a la Democracia para restablecer la vigencia de la Constitución de la República Bolivariana de Venezuela, aprobada al apenas finalizar el año 2022, que de hecho es su derogatoria, le pone término, inconstitucionalmente, al Encargado de la Presidencia de la República. Se limita a aprobar la continuidad constitucional de la Asamblea Nacional electa de 2015, a cuyo efecto asume para sí las competencias propias del Poder Ejecutivo, prosternando al poder constituyente y provocando una mutación fáctica en fraude de la Constitución. Destruye, así los fundamentos jurídicos y políticos que le dieran razón de ser, legitimidad y sentido finalista a la llamada transición, que ahora desaparece.

The reform of the Statute that governed the Transition to Democracy and to restore the validity of the Constitution of the Bolivarian Republic of Venezuela, approved at the end of 2022, which in fact is its repeal, unconstitutionally puts an end to the Person in charge of the Presidency of the Republic. It limits itself to approving the constitutional continuity of the National Assembly elected in 2015, for which purpose it assumes for itself the powers of the Executive Power, prostrating the constituent power and causing a factual mutation in fraud of the Constitution. It destroys, thus, the legal and political foundations that would give raison d'être, legitimacy and finalist sense to the so-called transition, which now disappears.
