Armonización tributaria estadal y municipal. Proyecto de Ley Orgánica de Coordinación y Armonización de Potestades Tributarias Estadales y Municipales

Abstract

La estructura federal que caracteriza al Estado venezolano, en virtud de la cual concurre el ejercicio de poder tributario entre República, estado y municipios, justifica la adopción por parte de la Asamblea Nacional de medidas de armonización. El ejercicio de tal competencia es materia de reserva de ley y no puede traducirse en el desconocimiento de la autonomía de la que están dotados los entes menores, de ahí la importancia de evaluar la pertinencia y suficiencia de la iniciativa parlamentaria contenida en el proyecto de ley aprobado en primera discusión en 2022, con miras a formular observaciones, sugerencias y denuncias que contribuyan a que el remedio no termine agravando la enfermedad.

The federal model adopted by the Venezuelan State, integrated by the Republic, the states and the municipalities, justified the adoption by the Parliament of measures addressed to harmonize the exercise of the tax power assigned to each of them. The adoption of this kind of measures has to be made through laws and cannot dismissed the autonomy of the so call minor entities. That is why it is so important the evaluation of the pertinence and sufficiency of the parliamentary initiative represented by the project of law approved in first discussion in 2022, to formulate comments and alerts that impede that the remedy turns worse than the illness.
