La controversia del Esequibo y el fantasma de Federico de Marten

Abstract

La Corte Internacional de Justicia está llamada a determinar la nulidad o validez del laudo de París, emitido por un tribunal arbitral que presidió Federico de Martens. Para poder juzgar si, en ese proceso, de Martens actuó con independencia e imparcialidad, hay que examinar su formación, su carácter, sus ideas, su personalidad, y su trayectoria. Es a partir de esos elementos que nos podremos formar un juicio sobre su participación en el arbitraje del Esequibo, y sobre la validez de un laudo dictado con su participación decisiva.

The International Court of Justice has been called upon to give a judgment on the nullity or validity of the Paris award, issued by an arbitral tribunal presided over by Friedrich von Martens. In order to assess whether, in that capacity, Martens acted as a judge, independently and impartially, it is required to take into consideration his training, his character, his ideas, his personality, and his career. It is only after an appraisal of these elements that we will be able to form a judgment on his crucial participation in the Essequibo arbitration, and on the validity of an award rendered with his participation.
