El problema de la jurisprudencia como fuente de derecho y el precedente judicial en un Estado democrático de derecho

Abstract

Este artículo analiza la doctrina que ha venido desarrollando la Sala Constitucional del Tribunal Supremo estableciendo precedentes judiciales obligatorios la luz de la necesaria libertad de interpretación judicial para garantizar la autonomía del Poder Judicial en un Estado democrático de Derecho.

This article analyzes the doctrine that has been developed by the Constitutional Chamber of the Supreme Court establishing mandatory judicial precedents, in the light of the necessary freedom of judicial interpretation to guarantee the autonomy of the Judiciary in a democratic State of Law.
