Abstract

El elemento esencial que caracteriza al derecho administrativo de un Estado democrático de derecho se encuentra cuando el mismo deja de ser un derecho exclusivamente del Estado, y pasa a ser realmente un derecho administrativo encargado de garantizar el punto de equilibrio que en una sociedad democrática tiene que existir entre los poderes del Estado y los derechos de los administrados. En el marco de un régimen autoritario, ese equilibrio por esencia no existe, o es muy débil o maleable, y por ello es que en dicho régimen el derecho administrativo no es un derecho democrático, aun cuando pretenda someter el Estado al derecho.

The essential element that characterizes the administrative law of a democratic Rule of Law State is found when it ceases to be a legal framework exclusively of the State, and becomes a law established to guaranteeing the equilibrium point that in a Democratic society has to exist between the powers of the State and the rights of the citizens. In the framework of an authoritarian regime, this balance essentially does not exist, or it is very weak or malleable, and that is why administrative law is not a democratic body of laws, even when if it tries to submit the State to the law.
