Apuntes sobre el reto del derecho de ser “Administrativo”, Tout Court, acorde con nuestro tiempo

Abstract

Uno de los aspectos de mayor complejidad, ya no solo del Derecho administrativo, sino de cualquier área del Derecho, es la distinción clásica entre la realidad práctica, la metodología aplicativa y académica del Derecho. En esta oportunidad nos centraremos en la aproximación metodológica de análisis y de explicación orientada directamente al análisis de la «conexión» entre, por un lado el sistema del Derecho administrativo, y por el otro, la realidad administrativa o política, tema central de este ensayo: en suma, la presencia y la «aplicación del Derecho administrativo», distinto al académico de elaboración de teorías que permiten comprender y explicar mejor el funcionamiento del sistema normativo de una sociedad en un momento dado.

One of the most complex aspects, not only of Administrative Law, but of any area of law, is the classic distinction between practical reality, methodology applicative and academic law. In this opportunity we will focus on the methodological analysis and explanation approximation focused directly on the analysis of the "connection" between, on the one hand, the system of Administrative Law, and on the other, the administrative reality or politics, which is the main aim of this essay: in short, the presence and «application of Administrative Law», different from the academic elaboration of theories that allow understanding and better explain the functioning of the regulatory system of a society at any given time.
