Del derecho de acceso a la información pública. Precedente fundamental de un modelo de gobierno abierto

Abstract

El derecho de acceso a la información pública se refiere a la libertad

de los ciudadanos de buscar, solicitar, acceder, recibir, utilizar, reutilizar y difundir la información que maneja el Estado como producto de su actividad, siempre y

cuando ésta no se encuentre explícitamente tipificada en excepciones, y sin interferencia de las autoridades públicas; en la actualidad, haciendo un adecuado uso de

las herramientas que nos ofrece la legislación vigente en la mayor parte de los

países de Latinoamérica, pueden dirigirse peticiones de información a los entes de

la administración pública y estos están obligados, de conformidad con las leyes

especiales en la materia, a dar oportuna y adecuada respuesta, incurriendo en

responsabilidad en caso de negar información y obstruir el ejercicio de este derecho humano fundamental ampliamente reconocido por distintos tratados y acuerdos internacionales.

The right of access to public information refers to the freedom of citizens to search, request, access, receive, use, reuse and disseminate the information handled by the State as a product of their activity, as long as it is not explicitly typified in exceptions by the law, and without interference from public authorities. Making appropriate use of the tools offered by current legislation in most of the countries of Latin America, requests for information can be addressed to public administration entities, and they are obliged, in accordance with special laws on the matter to give a timely and adequate response, incurring responsibility in case of denying information and obstructing the exercise of this fundamental human right, widely recognized by different international treaties and agreements. From the right of access to information derive concepts and models that currently are those that govern the functioning of institutions in democratic systems. In this analysis, reference is made to the open government model, as well as the influence that open data has on it, in order to illustrate those who approach the study of this subject about its main characteristics and interactions.
