Espíritu y líneas maestras del Estado democrático de Derecho

Abstract

El Estado de Derecho surge, en Venezuela, como resultado de la revolución de independencia y el intento de organizar a la naciente nación como una República, tal y como explicara Juan Germán Roscio. La posterior democratización del sistema político venezolano permitió consolidar las bases constitucionales del Estado de Derecho, aun cuando la crisis del sistema político, promovido por las instituciones del Petro-Estado, llevó a buscar soluciones al margen del Estado de Derecho, como resultó del proceso constituyente de 1999. A partir de entonces, el Estado democrático de Derecho en Venezuela sufrió un paulatino proceso de retroceso, al punto que perdió todo sentido como ordenamiento jurídico susceptible de promover la cohesión social.

The rule of law arises, in Venezuela, as a result of the independence revolution and the attempt to organize the new nation as a Republic, as explained by Juan Germán Roscio. The subsequent democratization of the Venezuelan political system allowed the consolidation of the constitutional foundations of the rule of law, even when the crisis of the political system, promoted by the institutions of the Petro-State, led to the search for solutions outside the rule of law, as resulted from the 1999 constituent process. From then on, the constitutional democracy in Venezuela suffered a gradual process of regression, to the point that it lost its ability to promote social cohesion.
