El rol del Estado en la emergencia ocasionada por el COVID-19

Abstract

En este artículo se analiza el rol del Estado en situaciones de emergencia, partiendo de la premisa la misma está regulada en la propia Constitución la cual establece sus limitaciones, entre las cuales está que la misma no origina nuevos poderes a favor de los gobernantes, y su ejercicio siempre debe realizarse, de manera restrictiva y extraordinaria, con el fin de preservar la subsistencia de la sociedad y del Estado; pudiendo limitarse derechos de las personas, solo de manera transitoria, mientras dure ese estado de necesidad originado por la situación de emergencia, y siempre que los mismos no se desnaturalicen.

This Paper analyses the role of the State in situations of emergency, which are regulated in the Constitution, in which are its limits are stated, in the sense that through it is not possible to grant new Powers to the government, and its exercise must always be accomplished in a restrictive and extraordinary way, for the purpose of preserve the existence of society and of the State. Within such powers, restrictions can be enacted regarding the citizen’s rights and freedoms, but only in a transitory way, during the state of necessity originated by the emergency, and without denaturalizing them.
