Digitalización de la Justicia Civil en Venezuela en Tiempos de Pandemia

Abstract

Esta investigación tuvo como principal objetivo analizar el impacto jurídico-técnico que tuvo la pandemia por COVID-19 en el sistema de justicia en Venezuela, el cual fue parte de un proceso de digitalización y optimización a partir del año 2020 respecto a la nueva modalidad para el trámite de los procesos civiles el cual se llevaba a cabo exclusivamente de forma presencial. Como resultado se determinó que efectivamente hubo un gran cambio en la jurisdicción civil sobre la manera de iniciar un procedimiento a través de medios electrónicos y su posterior anexo al expediente físico en la sede del tribunal correspondiente cumpliendo con las medidas establecidas por el Ejecutivo Nacional y el Tribunal Supremo de Justicia. De forma que se emplearon fuentes bibliográficas y jurisprudenciales con la finalidad de explicar el fenómeno planteado a través de esta investigación jurídico-dogmática, utilizando el método hermenéutico jurídico.

The main objective of this research was to analyze the legal-technical impact that the COVID-19 pandemic had on the Venezuelan justice system, which was part of a digitalization and optimization process since 2020 about the new modality for the civil procedure which were developed exclusively in person. As a result, it was determined that there was indeed a great change in the civil jurisdiction regarding the way of initiating a procedure through electronic means and its subsequent attachment to the physical file at the corresponding courthouse, abiding by the rules established by the Executive power and the Supreme Court of Justice. bibliographic and jurisprudential sources were used in order to explain the phenomenon raised through this legal-dogmatic research, using the legal hermeneutic method.
