Valoración jurídica de las reservas económicas y la intervención del Estado Venezolano

Abstract

La presente investigación pretende escudriñar acerca de una técnica de intervención estatal dentro de la economía muy particular llamada: la Reserva Económica. Ello se debe a que existe un profundo halo de oscurantismo en torno a la presente potestad Estatal. Para tales fines, la investigación se ceñirá a una investigación de corte descriptivo con matices propios del método dogmático-heurístico para desenmarañar su marco normativo. La investigación concluyó como, la Reserva Económica no tiene características uniformes perfectamente sistematizadas, de conformidad con los cuatro casos que fueron objeto de implementación desde el 2007, hasta la actualidad. También, que no existen suficientes garantías sustantivas ni adjetivas de los derechos económicos, trayendo como efecto, que las Leyes sean arbitrarias, frente a los operadores económicos.

The next investigation aims to explain about a very special state intervention’s technique over the economy called: The Economic Reserves. The reason derives of a strong shadow of obscurantism involved over this State’s Power. In this order of ideas, the investigation pretends to describe the topic using the dogmatic-heuristic method over the laws which set up these nationalization. The investigation concluded that these techniques have not a uniform standard perfectly systematized; according the 4 cases applies the last 13 years over Venezuela’s economy. It is important to stand out too, that today does not exists guarantees, which protects the economic rights involves in those cases, because these does not exists neither. The economics reserves of the last 12 years put on in Venezuela are characterized by the outrage of the State’s techniques over the enterprises.
