El derecho a la identidad de las personas transgénero

Abstract

El presente trabajo de investigación tuvo como objetivo verificar el respeto al derecho a la identidad de las personas transgénero en el ordenamiento jurídico venezolano ante la imposibilidad de las mismas de modificar sus datos personales con motivo de adecuarlos a la información real que las identifica e individualiza. El tipo de investigación fue documental y se utilizó el método analítico. Los resultados de la investigación concluyeron que el derecho a la identidad de las personas transgénero incluye la identidad de género y se ve afectado en los casos en que no se respeta la verdad biográfica de las personas.

The purpose of this research paper was to verify the respect for the right to identity of transgender people in the Venezuelan legal system, given the impossibility to modify their personal data in order to adapt them to the real information that identifies and individualizes them. The type of research was documentary and the analytical method was used. The results of this investigation concluded that the right to identity of transgender people includes gender identity and is affected in cases where the biographical truth of people is not respected.
