Situación de los juicios de divorcio a partir de las sentencias 446/14, 693/15 y 1070/161 de la Sala Constitucional del Tribunal Supremo de Justicia en materia de divorcio

Abstract

La investigación pretende analizar la situación de las solicitudes de divorcio a partir de las sentencias 446/14, 693/15 y 1070/16 de la Sala Constitucional del Tribunal Supremo de Justicia en materia de divorcio. Se utiliza la estrategia de investigación documental y el método analítico. Las fuentes para la recolección de información son de carácter: jurisprudencial, legal y doctrinal. Se obtuvo como resultado la formulación de un modelo procesal único y eficaz en materia de divorcio que concuerde con la aplicación de todas las pretensiones de divorcio derivadas de la interpretación realizada por la Sala Constitucional del Tribunal Supremo de Justicia.

The overall objective of this research was to analyze the procedural consequences with respect to the multiplicity of criteria in substantive matters in order to respond to the dissolution of the matrimonial bond, since nowadays the Constitutional Chamber of the Supreme Court of Justice assumes the procedural guidelines that it has for this kind of situations. The documentary research strategy and the analytical method are used. As a result, was formulate a unique and effective procedural model in matters of divorce that admits the application of all divorce claims arising from the interpretation made by the Constitutional Chamber of the Supreme Court of Justice.
