Interpretación judicial de los derechos económicos en Venezuela (2000-2016)

Abstract

El objetivo de este ensayo es estudiar el desarrollo del criterio interpretativo de la Sala Constitucional del Tribunal Supremo de Justicia venezolano, sobre el contenido y las restricciones de los derechos a la libertad económica y a la propiedad, atendiendo a la cláusula constitucional de Estado social, para verificar si el tribunal ha promovido y/o legitimado la tendencia intervencionista del gobierno venezolano en materia económica. La investigación se basó en el análisis e interpretación de la jurisprudencia más relevante de la Sala Constitucional sobre el concepto constitucional de Estado social y las normas constitucionales sobre derechos económicos, desde 2000 hasta 2016, advirtiendo el contexto político y económico. Se concluye que ciertas decisiones de la Sala han incidido en la configuración de la política económica para favorecer el intervencionismo estatal, afectando la libertad económica y la propiedad.

The aim of this essay is to study the development of the interpretative approach of the Constitutional Chamber of the Supreme Court of Justice of Venezuela, on the content and restrictions of rights to economic freedom and property, based on the Social State constitutional clause, to verify whether the court has promoted and / or legitimate an interventional trend of the Venezuelan government on economic matters. The research was based on the analysis and interpretation of relevant jurisprudence of the Constitutional Chamber on constitutional concept of Social State and constitutional norms on economics rights, from 2000 to 2016, noting the political and economic context. It is concluded that some decisions of the Constitutional Chamber have affected the economic policy making in order to encourage state intervention, affecting economic freedom and property.
