Abuso de derecho a la libertad religiosa: organizaciones civiles devotas

Abstract

El derecho a la libertad religiosa es un derecho fundamental pero no absoluto. La creación de un ambiente de odio, rechazo y desinformación a través de su ejercicio produce una alteración de la convivencia pacífica en sociedad, que socava los cimientos de la democracia y la progresividad. Cuando organizaciones civiles, con justificación en el ejercicio de este derecho, extralimitan el objeto de su otorgamiento obrando en perjuicio de terceros, se configura un claro abuso de derecho lo que acarrea la responsabilidad civil y el cese de la actuación abusiva.

The right to religious freedom is a fundamental but not absolute right. The creation of an atmosphere of hatred, rejection and disinformation through its exercise produces an alteration of peaceful coexistence in society, which undermines the foundations of democracy and progressiveness. When civil organizations, with justification in the exercise of this right, exceed the object of its granting, acting to the detriment of third parties, a clear abuse of right is configured, which entails civil liability and the cessation of the abusive action.
