El régimen de filiación y sucesión de hijos concebidos por fecundación post mortem en Venezuela

Abstract

El creciente avance tecnológico de las técnicas de reproducción asistida ha generado procedimientos como la fecundación post mortem,lo que tiene especial incidencia en el régimen de filiación y sucesión de los hijos concebidos por esta, sobre todo a la luz de un vacío legal inminente. En Venezuela solo se tiene lo dictaminado en la sentencia No. 1456 de la Sala Constitucional del Tribunal Supremo de Justicia, sin embargo, esta no logra subsanar los desafíos que le son propios a la determinación de un régimen de filiación y sucesión para los hijos concebidos por fecundación post mortem.Por esto, se pretenden estudiar las bases de las instituciones de la filiación y la sucesión, así como las experiencias comparadas y la sentencia de la Sala Constitucional en la materia, en aras de identificar las bases necesarias para un instrumento legal idóneo para el caso venezolano.

The growing technological advance of assisted reproductiontechniques has brought about new procedures such as post mortemfertilization, which has special incidence in the regulation regardingfiliation and succession of children who are conceived in this manner. In Venezuela the only regulation governing this matter can be found within the OpinionNo. 1456 of the Constitutional Chamber of the Supreme Tribunal, however, this fails to fill the gaps left by the lack of legislation in the matter. Because ofthis, we intend to study the basis of the legal concepts offiliation and succession, comparedexperiences in the matter and the opinion of the Supreme Tribunal’s Constitutional Chamber, with the goal of identifying the necessary basis for an ideal legal instrument for the Venezuelan context.
