El Derecho a la fiel interpretación de la Constitución y una mirada hacia el originalismo

Abstract

La existencia de un derecho ciudadano a la Constitución tiene importantes implicaciones como su supremacía y su tutela judicial efectiva; sin embargo, en el contexto actual, no se puede omitir el papel preponderante de los jueces constitucionales en la aplicación de dichas normas, que hace fundamental el reconocimiento del derecho a la fiel interpretación constitucional. En este sentido, la interpretación debe ser guiada por la voluntad constituyente, de modo que se estima correcta la aproximación originalista a esta labor, que tiene por norte la búsqueda del significado que se fijó de forma soberana en el momento de adopción de la Constitución, configurándose verdaderamente la garantía del derecho a la fiel interpretación de la norma constitucional.

The existence of a citizen right to a Constitution has important implications, as its supremacy and its effective judicial protection; nonetheless, in the current context, we cannot omit the principal role of constitutional judges on the application of such norms, making the recognition of a right to a loyal interpretation of the Constitution, fundamental. This interpretation must be guided by the constituent will, so the originalist approximation is considered correct, as it has as a north the search of the meaning that was stated sovereignly at the adoption of the Constitution, thus, truly setting up the warranty to the right of a loyal interpretation of the constitutional norms.
