La enseñanza del derecho constitucional en Venezuela

Abstract

El inicio del estudio del Derecho Público y posteriormente del Derecho Constitucional en Venezuela, se vinculó durante el siglo XVIII, con el estudio de las instituciones de Derecho Español y Eclesiástico en el antiguo Seminario luego Universidad de Caracas. De allí salió la cantera de los juristas que tuvieron la responsabilidad de redactar los primeros documentos constitucionales en 1810 y 1811.De esta manera, en 1811 comienza la construcción del constitucionalismo venezolano para lo cual, la enseñanza de las ideas políticas liberales que inspiraban el constitucionalismo clásico, va a ser fundamental para la formación de los juristas que debían participar en el diseño y ejecución de esa tarea.La enseñanza del Derecho Constitucional en Venezuela fue evolucionando durante el resto del siglo XIX y comienzos del siglo XX, a través del establecimiento en las universidades de cátedras, programas y los profesores especializados. Va a ser a partir de la segunda mitad del siglo XX cuando la enseñanza del Derecho Constitucional se afianza y adquiere su madurez, con la influencia de profesores extranjeros y venezolanos que salen a hacer sus estudios al exterior. En el siglo XXI en la actualidad, el Derecho Constitucional tiene el reto de enseñar los principios y reglas en los que se basa la Constitución de 1999, pero a su vez hacer una visión crítica de la constitución real que se ha impuesto en virtud del desmantelamiento del Estado de Derecho, la ausencia de independencia judicial y de democracia.

The beginning of the study of Public Law and later of Constitutional Law in Venezuela was linked during the eighteenth century, with the study of the institutions of Spanish and Ecclesiastical Law in the old Seminary, then University of Caracas. From there came the quarry of jurists who had the responsibility of drafting the first constitutional documents in 1810 and 1811. In this way, in 1811 the construction of Venezuelan constitutionalism began, for which, the teaching of liberal political ideas that inspired constitutionalism classic, it will be essential for the training of the jurists who should participate in the design and execution of this task. The teaching of Constitutional Law in Venezuela was evolving during the rest of the 19th century and the beginning of the 20th century, through the establishment of chairs, programs and specialized professors in the universities. It will be from the second half of the 20th century when the teaching of Constitutional Law takes hold and acquires its maturity, with the influence of foreign and Venezuelan professors who go abroad to do their studies. In the 21st century today, Constitutional Law has the challenge of teaching the principles and rules on which the 1999 Constitution is based, but at the same time making a critical view of the real constitution that has been imposed by virtue of the dismantling of the rule of law, the absence of judicial independence and democracy.
