El proyecto de ley de ciudades comunales. Nueva fase: en la construcción del Estado comunal paralelo al constitucional

Abstract

El proyecto de ley de Ciudad Comunal constituye una nueva pieza en el andamiaje en cuanto a la construcción de un Estado paralelo al previsto en la Constitución vigente de 1999. Se trata del socavamiento de las instituciones y estructuras constitucionales previstas en la Constitución de 1999 por el Modelo de Estado Comunal, y que puede ser catalogado como de fraude constitucional, de desconstitucionalización o de perversión constitucional, en el sentido de dejar pervivir una estructura constitucional que paulatina y progresivamente va siendo sustituida por otra hasta dejarla vacía de contenido o socavada. Se trata de ir infiltrando o penetrando las estructuras constitucionales e institucionales sustituyendo su esencia y cambiándola por otra. Se hace una referencia a los antecedentes legislativos, se indica la centralización de recursos financieros, la reducción de ingresos a los municipios y estados para otorgárselos a los consejos comunales y organizaciones de base del poder popular, y se analiza el proyecto de ley orgánica de Ciudades Comunales sometido a proceso de consulta pública en marzo de 2021.

The communal city draft bill constitutes a new piece in the staging regarding the construction of a State parallel to the one provided for in the 1999 Constitution in force. It entails the undermining of the constitutional institutions and structures provided for in the 1999 Constitution by the Communal State Model, which can be classified as a constitutional fraud, deconstitutionalization or constitutional perversion, in the sense of permitting the survival of a constitutional structure that is gradually and progressively being replaced by another until it is empty of content or undermined. It involves infiltrating or penetrating the constitutional and institutional structures, substituting their essence and changing it for another. The article includes a reference to the legislative antecedents, the centralization of financial resources, the reduction of income to the municipalities and states to grant them to the communal councils and grassroots organizations of the popular power, as well as an analysis of the organic law project of the Communal City submitted to a public consultation process in March 2021.
