La tutela judicial efectiva en clave de derechos humanos. El control de convencionalidad de algunos criterios de la SC-TSJ relacionados con la tutela judicial efectiva

Abstract

La tutela judicial efectiva, como derecho y garantía procesal, tiene su fundamento en el derecho internacional de los derechos humanos; por su misma internacionalización, su interpretación y aplicación en el orden interno debe ajustarse a los estándares del sistema de protección de derechos humanos. Por tanto, los derechos procesales, en la medida que se encuadren en el catálogo de los derechos humanos, deben pasar por un control de convencionalidad en el orden interno, aplicable por todos los jueces de la República, para minimizar los riesgos de indebida limitación o restricción. En el desdoblamiento de la tutela judicial efectiva dentro del orden interno venezolano, los derechos al acceso al órgano jurisdiccional, a la motivación de la sentencia y a la ejecución de la sentencia son incompatibles con los criterios del sistema de protección de derechos humanos.

Effective protection of the court, as a procedural right and guarantee, is based on international human rights law; due to its internationalization, the interpretation and application in the national legal system must conform to the standards of the human rights protection system. Therefore, procedural rights, to the extent that they are framed in the catalog of human rights, must go through a conventionality control in the national order, applicable by all the judges of the Republic, to minimize the risks of undue limitation or restriction. In the unfolding of effective protection of the court within the Venezuelan internal legal system, the rights of access to the judicial procedure, to the justification of the sentence and the execution of the sentence are incompatible with the criteria of the human rights protection system.
