Funciones y perfil del compliance officer en el derecho penal económico contemporáneo

Abstract

Tomando en cuenta la importancia de los sistemas de gestión de Compliance en el Derecho Penal Económico contemporáneo, se hace un análisis de las funciones que está llamado a desempeñar a lo interno de la empresa el Compliance Officer así como de quién debe ser quien realice tales funciones. Se examinan diversas funciones decisivas del Compliance Officer destacándose lo clave que resulta su labor para el funcionamiento efectivo y adecuado de todo sistema de gestión de Compliance. Se concluye evidenciando que el Compliance Officer debe cumplir con un perfil y realizar unas funciones de gran exigencia que justifican la exposición de la temática.

Considering the importance of Compliance management systems in contemporary Corporate Criminal Law, an analysis is made of the tasks that the so-called Compliance Officer is called upon to performwithin the company as well as who should be that person. Various decisive tasks of the Compliance Officer are examined, highlighting how key their work is for the effective and proper functioning of any Compliance management system. It concludes by showing that the Compliance Officer must comply with a certain profile and perform demanding tasks that justify the presentation of the subject
