El control de la convencionalidad en el laudo arbitral

Abstract

La actividad del árbitro, al momento de dictar el laudo en los procesos arbitrales institucionales de derecho, es semejante a la del juez: se resume en convertirse en un operador jurídico con el deber de motivar su decisión. En la actualidad existe pleno consenso en que los jueces, tanto de instancia como los del Máximo Tribunal de la República, deben sujetar su fallo al control de la convencionalidad. Este ensayo abordará el tema de dicho control desde la perspectiva de la motivación del laudo.

The activity of the arbiter, at the moment of issuing the arbitral award through the institutional arbitral proceedings of the law, is similar to one of a judge: it is condensed in becoming a legal practitioner with the duty of justifying his decision. Nowadays there exists consensus that judges, both from instance and from the highest court of the republic, must subject their decision to control of conventionality. This article will take on the subject of the aforementioned control from the justification of the arbitral award sphere and perspective.
