Mecanismos judiciales de actualización del valor de obligaciones en moneda extranjera en Venezuela. Análisis jurisprudencial

Abstract

Ante la discusión sobre cómo actualizar el valor de obligaciones pactadas en moneda extranjera, en un entorno en el cual ello se estipula así cada vez con mayor frecuencia, se pretende una aproximación acerca de lo que debería ser desde el punto de vista legal y doctrinario, y de la misma manera, hacer una aproximación a lo que económica o contablemente debería ser. Del mismo modo, se analiza la forma en la cual los tribunales venezolanos, en sus distintas competencias, han asumido la forma de calcularlo, la aplicación de tasas cambiarias, intereses de diverso tipo y, asimismo, modalidades de indexación. Se pretende proponer una vía por la cual se establezcan claramente y sin confusiones, los mecanismos para actualizaciones de valor tanto extrajudicialmente como en el transcurso de un proceso judicial por medio de experticias complementarias de los fallos. Se pretende ofrecer propuestas para la adecuación de las normas en el derecho venezolano.

Given the discussion on how to update the value of obligations agreed in foreign currency, in an environment in which this is agreed in this way with increasing frequency, an approximation is sought about what it should be from a legal and doctrinal point of view, and in the same way, make an approximation of what it should be economically or accounting. In the same way, the method by which the Venezuelan courts, in their different jurisdictions, have assumed the way of calculating it, the application of exchange rates, interests of various kinds and also forms of indexation is analyzed. It is intended to propose a way by which the mechanisms for value updates are established clearly and without confusion, both extrajudicially and in the course of a judicialprocess through complementary accounting expertise of the judgments. It is intended to offer proposals for the adaptation of the norms in Venezuelan law.
