La prevaricación en la práctica del derecho venezolano

Abstract

El propósito de este ensayo es deliberar acerca de la prevaricación en la práctica del derecho venezolano. Los fundamentos epistemológicos en esta disertación están vinculados con las ciencias jurídicas y son explicitados en un orden cognoscente con la intención de interpretar y comprender los significados en el ejercicio de la abogacía. El sustento metodológico del análisis argumentativo se basó en la revisión documental de los planteamientos teóricos relacionados con el ejercicio de la carrera de derecho, la práctica empírica y los planteamientos éticos. Se concluye que la prevaricación, está reñida con la práctica de la abogacía la cual debe estar regida por los más altos principios altruistas del ser humano y en principio ello debería ser así, es decir, la honestidad, la integridad, la lealtad y la probidad, el estudio, el conocimiento y la rectitud deberían ser el norte de todo aquel que se ha dedicado al estudio de las leyes y a la defensa del derecho y la justicia, pero hay excepciones.

The purpose of this essay is to deliberate about prevarication in the practice of Venezuelan law. The epistemological foundations in this dissertation are linked to the legal sciences and are made explicit in a cognitive order with the intention of interpreting and understanding the meanings in the practice of law. The methodological support of the argumentative analysis was based on the documentary review of the theoretical approaches related to the exercise of the law career, empirical practice and ethical approaches. It is concluded that prevarication is at odds with the practice of law which must be governed by the highest altruistic principles of the human being and in principle this should be so, that is, honesty, integrity, loyalty and probity, the study, the knowledge and the rectitude should be the north of all those who have dedicated themselves to the study of the laws and to the defense of the law and justice, but there are exceptions.
