Reinstitucionalización del Poder Judicial. Una perspectiva desde la independencia y la objetividad

Abstract

La crisis que atraviesa el Poder Judicial en Venezuela tiene una génesis histórica de larga data, con diversas aristas que se esbozan en esta investigación. A fin de concretar el Estado de Derecho que a su vez garantice la democracia, crecimiento de la economía y legitimidad, se requiere de una revisión urgente del modelo actual. A tal efecto se analiza el concepto de independencia, la evolución del Poder Judicial en Venezuela, los factores actuales que aquejan su funcionamiento y se realiza una propuesta que permite la materialización de la independencia, a través de la elección de los mejores con base en criterios objetivos, que garanticen que el juez pueda ejercer su función sólo atendiendo al derecho y al contenido del expediente.

The crisis that the judiciary is undergoing in Venezuela has a long-standing historical genesis, with various edges that attempt to outline this investigation. In order to achieve the rule of law that allows democracy, economic growth and legitimacy, an urgent revision of the current model is required. With this porpouse, the concept of independence, the evolution of the judiciary in Venezuela, the current factors that affect its operation will be analyzed and a proposal is made that allows the materialization of independence, through the election of the best on an objective basis, that guarantee that the Judge can exercise his function only according to the law and the content of the file.
