Relación de las sentencias dictadas en materia del recurso de interpretación por la Sala Constitucional del Tribunal Supremo de Justicia durante el período 2000-2018

Abstract

La observación del fenómeno de investigación está constituida por la totalidad de sentencias dictadas por la Sala Constitucional conociendo de los recursos de interpretación interpuestos. La recopilación se realiza haciendo uso dela base de datos del Tribunal Supremo de Justicia, tomadas de la página web www.tsj.gob.ve, concretamente de la referida a “Decisiones de la Sala Constitucional”, desde donde se identifican los recursos interpretativos interpuestos en el periodo en estudio y se extrae de cada decisión la data de la solicitud interpuesta sea que se haya declarado o no su procedencia, a fin de identificar cuantas sentencias en el ámbito del recurso de interpretación han sido dictada por la Sala Constitucional y sobre cuales artículos constitucionales se ha suscitado las mayores dudas.

The object of the investigation’s phenomenon is constituted by the totality of decisions ruled by the Constitutional Chamber when hearing interpretation writs. The compilation is madebyusing the database of the Supreme Tribunalof Justice, available at itswebsite www.tsj.gob.ve, specifically on itssection"Decisions of the Constitutional Chamber", from where the interpretive resources are identified within the studied periodand the dataof each writis extracted from each decision –whether or not they have been ruled admissible –, in order to identify how many decisionsconcerning theinterpretation resource have been ruledby the Constitutional Chamber, and which constitutional articles have raised the greatest doubts.
