La unión estable de hecho y sus diferencias con el matrimonio

Abstract

La Unión Estable de Hecho o Concubinato, es una figura jurídica usada comúnmente por la sociedad venezolana para obtener los mismos efectos del matrimonio pero sin realmente celebrarlo, sin embargo en el presente trabajo es nuestra intención manifestar porque se trata de instituciones jurídicas distintas y cuyas consecuencias jurídicas sin duda alguna no son iguales, haciendo especial énfasis en los derechos sucesorales de los concubinos, al respecto la mayoría del gremio profesional afirma que éstos si tienen vocación hereditaria, en el recorrido de este artículo explicaremos porque a nuestro criterio esto no es posible, esperando aclarar las interrogantes que existen al respecto.

The Civil Union,or Concubinage, is a legal figure commonly used by Venezuelan society with the purpose of obtaining the same effects of marriage without actually celebrating it, however in this paper it is our sole intention to state why both of them represent different legal institutions whose consequences are undoubtedly not the same, with special emphasis on the hereditary rights of the concubines, whichthe majority of the legal society affirm that they do have a hereditary rights. In the body of this article we will explain why, in our perspective, this is not possible, hoping to clarify the questions that exist about it.
